IHC Grants Bushra Bibi’s Request for Transfer to Adiala Jail


The Islamabad High Court (IHC) has granted the request of former Prime Minister Imran Khan’s wife, Bushra Bibi, to transfer her from their Banigala residence, which had been designated as a sub-jail, to Adiala Jail, where her husband is currently held.

Justice Miangul Hassan Aurangzeb delivered the verdict, which had been reserved earlier.

Last week, the IHC had reserved its decision on Bushra Bibi’s plea.

Although the petition had been dismissed last month due to the absence of Bushra Bibi’s lawyers, a plea was filed the same day to reinstate it.

Bushra Bibi was arrested on January 31 after an Islamabad accountability court sentenced her and Imran Khan to 14 years in jail in the Toshakhana reference.

While the IHC had suspended their sentences in the Toshakhana case on April 1, Bushra Bibi remains in custody in the Iddat case, while Imran Khan is incarcerated in other cases.

After the Toshakhana verdict, Bushra surrendered herself to the authorities at Adiala Jail, where the National Accountability Bureau’s team was waiting. Subsequently, she was taken into custody by the anti-graft watchdog.

However, her residence was declared a sub-jail through a late-night notification, leading to her relocation to Banigala. The decision to move her to the residence had been under discussion for months, as both she and her husband denied submitting any application for its designation as a sub-jail.

Nearly a week after her arrest, Bushra Bibi contested the designation of her residence as a sub-jail, urging the IHC to allow her to serve her 14-year sentence in Adiala Jail.

During a subsequent hearing, the Adiala Jail administration opposed her transfer back to the prison, citing security concerns due to overcrowding.

In March, Justice Miangul Hassan Aurangzeb questioned whether authorities had sought Imran Khan’s permission before converting his Banigala residence into a sub-jail.
